The JSE Recruitment Policy only applies to employers that employ people under Part 3 of the Public Administration Act 2004 (PAA), and to the employees employed under that Part.
Ministerial staff are employed under Section 6 of the PAA and are employed by the Premier. Parliamentary advisers are separately employed by an elected member of the Parliament of Victoria on behalf of the Crown. Accordingly, neither ministerial officers or parliamentary advisers are eligible to access the JSE.
It is possible that some people may be on secondment from a department to a ministerial office. If so, then they would remain employed by the relevant department and would continue to have JSE access. Some people may also have left the VPS and still have access to the JSE by virtue of the extended access provisions.
